Personal data policy

How we collect, use and protect your personal data, and how you can access, correct or delete it.

Preliminary version, under review by our attorney.

1. Who is responsible for your data

Raíz Andina Realty S.A.S. (in formation), “Raiz Andina”.

This policy follows Colombian data protection law: Law 1581 of 2012, Decree 1377 of 2013 (now part of Decree 1074 of 2015) and related rules.

2. What data we collect

We only ask for what we need to help you:

As a deal moves forward, the attorney or notary may need ID documents, a Colombian tax ID (RUT) or other details for the purchase agreement and the deed. We will tell you how they are used at that time.

We do not ask for sensitive data (health, racial or ethnic origin, religious or political beliefs, sexual orientation, biometrics). If it were ever needed, you would not be required to provide it and we would ask for separate consent.

Our services are not directed to anyone under 18, and we do not knowingly collect their data.

3. How we use your data

  1. To answer your questions and send the information you request.
  2. To show you properties that fit your search and arrange in-person visits.
  3. To schedule and hold video calls.
  4. To value and market a property you want to sell or rent.
  5. To connect you, with your permission, with attorneys, notaries or lenders for your transaction.
  6. To send you new listings, market updates and the buying guide, if you agreed. You can unsubscribe at any time.
  7. To call you or contact you by WhatsApp or text message, if you agreed.
  8. To measure and improve our website and advertising.
  9. To meet legal, accounting and tax obligations and respond to authorities.

We do not sell or rent your personal data.

4. Who we share your data with

We use technology providers that store or process data on our behalf and under our instructions:

We also share what is needed with Raiz Andina’s partners and advisors and, when you move forward with a transaction and agree, with the owner or buyer on the other side, attorneys, notaries and financial institutions.

Several of these providers store information on servers outside Colombia, mainly in the United States and the European Union. By accepting this policy, you authorize that international transfer, which is made to providers with adequate levels of protection.

5. Your rights

As the owner of your data, you can:

6. How to exercise your rights

We will ask you to confirm your identity before sharing or changing any information.

Requests are handled by Raiz Andina’s management.

7. Calls and text messages (clients in the United States)

If you give us your number and check the box, you agree to receive calls and text messages from Raiz Andina about properties and your request.

8. Visitors from Spain, the European Union and the United Kingdom

If you are in Spain, another EU country or the United Kingdom, the General Data Protection Regulation (GDPR) or the UK GDPR also applies. We use your data based on your consent and on the steps you ask us to take before a possible contract.

In addition to the rights in section 5, you can ask for portability of your data, object to its use for marketing or ask us to restrict its use. You can lodge a complaint with Spain’s data protection agency (AEPD) or, in the United Kingdom, with the Information Commissioner’s Office (ICO).

9. Cookies and measurement tools

Our website stores the currency you choose (COP, USD or EUR) in your browser so prices look the same on your next visit. We also use the Meta pixel, which records visits and actions on the site (such as submitting a form or opening WhatsApp) to measure our ads. Visitors from Spain, the European Union and the United Kingdom are asked for permission before it is turned on. You can delete or block cookies in your browser settings.

10. Security and retention

We protect your data with reasonable measures: password-protected access, accounts limited to the Raiz Andina team and well-known providers.

We keep your data while we have a relationship with you and for as long as accounting, tax and commercial rules require. If you contacted us and no transaction followed, we will delete your data no later than 24 months after our last contact, unless you ask us to keep it.

11. Changes to this policy

If we make important changes, we will post them on this page and, where required, ask for your consent again.

Effective date: [publication date, pending]. Our databases will remain in effect for as long as Raiz Andina operates.
